Kitten Purchase Agreement

The Purpose of this contract is to protect all parties: the Purchaser/Owner, the Seller/Breeder, and that cat or kitten. If there are any problems, questions, or concerns, or issues that you need help with, Olmstead Colossal Coons is always here to help. We want the adoptive parent(s) and/or family to be completely happy with the new kitten and his or her transition to the new home. Transitioning is easy for some kittens but more difficult for others, and kittens/cats handle stress in various ways. If there are ANY issues, please call us at 615-423-4413. We will provide you with all the help we can to make this time easier for the new parents and the kitten.

Between Olmstead Colossal Coons Cattery, TICA Cattery #2045181, represented by Kathy Olmstead, Seller/Breeder, hereinafter referred to as Breeder and _______________________________________, Purchaser/Owner, hereinafter referred to as Owner, enter into this agreement:

  1. At the time of transfer, kitten is sold un-altered, without breeding rights.

2.  OBLIGATIONS AND GUARANTEES OF THE BREEDER

  • Breeder warrants that at the time of sale the kitten is clinically healthy and external signs of disease are absent.
    • Kitten is guaranteed to be free from external and internal parasites at time of transfer.
    • Kitten will have all vet recommended vaccinations for their age at time of transfer.
    • Kitten’s veterinary health record sheet will be provided to owner at time of transfer.
    • Owner must quarantine kitten from other animals in Owner’s home for 7 days and have kittens checked by a veterinarian within 4 days of transfer and notify breeder immediately of any defects. If Owner chooses not to have kittens checked by their veterinarian, the Breeder guarantees are voided at discretion of breeder.
    • If kitten is found within 4 days from the date of transfer, to have serious, life-threatening medical defects, Breeder will refund full purchase price of kittens to Owner and Owner will return kitten to Breeder within 30 days from the date of notice. If Owner chooses to keep kittens, no refund will be given.
    • Breeder will provide Owner with written instructions on the care, feeding, and accommodations of the kitten.
    • Breeder will provide Owner with the kitten’s registration papers/pedigree from either TICA or CFA upon proof of spay/neuter.
    • Breeder will transfer possession of the kittens to Owner upon receipt of the full $___________ for one kitten.
    • If kitten/kittens are found to be incompatible with Owner’s family, within 4 days, Breeder will exchange kitten for another currently available or upcoming kitten of equal value, within one year.
    • Breeder guarantees the kitten against lethal genetic or congenital defects for 12 months following the date of transfer. If, during these 12 months, the cat should die or have to be destroyed due to a genetic or congenital defect, the Breeder will replace the kitten with another kitten at the

Breeder’s earliest convenience, but within one year, should the following conditions be met: the Owner provides Breeder with a necropsy, by a licensed impartial Veterinary Pathologist, at the Owner’s expense, stating that the cause of death is unquestionably a genetic or congenital defect; a second

examination by a veterinarian of the Breeder’s choice corroborates these claims.

  • Breeder assumes no liability or responsibility for any veterinary care for this kitten/cat after the purchaser takes possession of said kitten/cat. Under no circumstances will the Breeder be responsible for any veterinary bills incurred by the Owner. Should the Owner encounter a situation requiring

necessary medical care beyond the Owner’s ability to provide for, the Breeder would like the opportunity to help where possible but is not obligated to help.

  • Breeder cannot guarantee final size, the development of color and fur quality, eye color, length of coat, temperament, behavior, food allergies, or any personality issues. Owner understands and acknowledges that if there is some area in Owner’s home where another animal or human has urinated, it is possible that the cat/kitten will want to do same in the contaminated area and that Breeder is not
  • responsible for such behavior. The kittens and cats are litter trained before being allowed to leave our possession.
  • The kitten is being sold without breeding rights and will not be altered prior to transfer. Owner must provide proof from licensed veterinarian of spay/neuter before receiving registration papers.
    • Breeder will immediately acknowledge written receipt of both the deposit and the final payment, upon receipt of each.
    • Owner may choose kitten from any upcoming litter and is not obligated to select from any specific litter. Owner will stay at their spot on the waitlist, or move higher as those above them have chosen, until they choose a kitten/kittens. Owners will be notified of availability when kittens are 8-10 weeks of age.
    • Breeder reserves the right to keep any kitten breeder chooses, and/or to withhold any kitten for observation.
    • Under no circumstances can breeder guarantee the show nor breeding success of the cat.
    • Breeder will not be responsible for the safety or well-being of the kitten/kittens during transport, should Owner choose to use any courier other than what is recommended by Breeder.

3.  RESPONSIBILITIES AND WARRANTIES OF THE OWNER

  • At the time of transfer to Owner, and/or including transfer to a courier other than any recommended by breeder, Owner assumes full responsibility for the kitten’s life, safety, and health.
    • The Owner agrees to comply with Breeder’s recommendations for quarantine and food after the time of purchase. Owner must quarantine the cat/kitten from other animals in owner’s home for a minimum period of 7 days. This measure will save the cat from additional stress during the time of settling in. It is important to give a young animal the time necessary to calmly get used to new people, new environment, other animals and different germs existing there. Stress weakens the immune system, which may evoke a banal respiratory or other illness. The cat/kitten may show consequences of stress such as nervousness, sneezing, discharge from the nose or eyes, diarrhea or constipation. The Owner is responsible for giving the cat/kitten all the necessary medical care at this period if needed, and for providing good nutrition and care. Owner understands and acknowledges that cats can be carriers of the viruses of calicivirus, rhinotracheitis (herpes,) coronavirus (which in some rare cases can mutate into FIP, which was once a death sentence but is now curable,) chlamydia, mycoplasmosis, etc., all of which can be exacerbated by stress. Owner is responsible for providing any care necessary and resulting from said viruses. Owner will notify Breeder in the event owner is unable to provide for any necessary care, so that Breeder has the opportunity to help when possible.
    • Owner agrees to keep the kittens in good conditions, to provide quality food that is appropriate for the needs of high quality kittens and to provide adequate qualified veterinary care.
    • Owner agrees to keep the kittens current on all veterinary recommended vaccinations.

3.5               OWNER AGREES THAT UNDER NO CIRCUMSTANCES WILL THEY EVER ALLOW THE KITTENS TO BE DECLAWED.

  • Owner agrees to notify Breeder in case of any loss of kitten due to illness, theft, or accident.
    • Owner agrees that under NO circumstances will the kittens EVER be sold or given to a pet shop, animal shelter, research laboratory, or similar facility. Should the owner for any reason, not be able to keep the above cat/kitten, the Breeder will be given the first opportunity to rescue the cat/kittens.
    • Owner agrees that under NO circumstance will this cat be tattooed, pierced, or undergo any

unnecessary “fashionable” body modification.

  • Owner agrees to never show the original pedigree of the Cat (including numbers) to a third party or any public resources or social network except the official representatives of the felinological organization/association/club/Pawpeds system.
    • Owner agrees to provide current photos of cat/kitten upon request of Breeder.

3.10       Owner will pay for all shipping costs, including any health certificates necessary and required for transport, should the owner choose to not pick up from Breeder in Saint Cloud, Florida.

4.  SETTLEMENTS BETWEEN PARTIES, CONSIDERATION, AND CONDITIONS OF SALE

  • The total cost of the kitten is $_________________ USD.
    • Within 2 days of execution of this agreement Owner will deliver to breeder the sum of $500.00 USD, as NON-REFUNDABLE deposit for Breeder to hold this kitten or kittens, or the owner’s place on the waitlist to choose kitten. Deposit may be paid by personal check, money order, cashier check, Venmo, Zelle, PayPal, bank wire, or Cash App. Owner will cover any money transfer related fees. Should the Owner after having paid the deposit, decide against purchasing the kitten, he or she forfeits the deposit, at Breeder’s discretion.
    • Owner will pay Breeder the balance of $4000.00 USD on or before transfer. If owner does not pay Breeder within the agreed time, but no later than 14 weeks of age, Owner waives all rights to kitten and deposit will not be refunded unless agreed upon in writing by both parties. This balance will be paid by means of Zelle, Venmo, bank wire transfer, PayPal, Cash, or Cash App. Owner agrees to pay for any fees associated with their preferred payment method.
    • The kittens are agreed to be the property of Owner only upon receipt of 100% of payment by the Breeder.
    • Animal price does not include expenditures on transportation.

5.  EXCLUSIVE JURISDICTION FOR SUIT IN CASE OF BREACH

  • Any legal action that may arise under the terms of this contract will be brought to Osceola County,

Florida or the Breeder’s current place of residence. The Owner and Breeder, by entering into this

agreement, submit to jurisdiction in Osceola County, Florida or the Breeder’s current place of residence, for adjudication of any disputes and/or claims between the parties under this Agreement. Furthermore, the Owner and Breeder hereby agree that the courts of Osceola County, Florida or the Breeder’s current place of residence, shall have exclusive jurisdiction over any disputes between the parties relative to this agreement, whether said dispute(s) sounds in contract, tort, or other areas of the law.

  • State Law – This Agreement shall be interpreted under, and governed by, the laws of the state of Florida.
    • All disputes will be resolved confidentially between the parties. Placing disputes beyond the framework of communication between the Owner and Breeder, including publicly on social media, exempts the Breeder from any responsibility.

6.  INTEGRATION

  • There are no other conditions or guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined in this contract.

7.  SEVERABILITY

  • In the event any provision of this contract is deemed to be void, invalid, or unenforceable, that provision shall be severed from the remainder of this contract so as not to cause the invalidity or unenforceability of the remainder of this contract.

Signature of the Owner and the Breeder indicate their full compliance and agreement with all the terms of this contract.
